Fishermen wishing to participate in the aggregate landings program for summer flounder during the Summer sub period (June – October) must complete the following application. Upon completion, the application should be mailed to (Nancy Scarduzio, 3 Fort Wetherill Road, Jamestown, RI 02835), emailed (nancy.scarduzio@dem.ri.gov), or faxed (423-1925) to the Division of Fish and Wildlife. Please submit applications as soon as possible.

Once the application is received, reviewed, and accepted by both the Division of Fish and Wildlife and the Division of Law Enforcement, an Aggregate Landings Permit shall be issued for the vessel. This review may take several days so please plan accordingly. Applications will not be accepted if you do not hold a Summer Flounder Exemption Certificate. Additionally, Fishermen who participated in the Winter 1 Aggregate Landings Program are not eligible to participate in the Summer Aggregate Landings Program.

This application is to solicit from the DEM Division of Law Enforcement and Fish & Wildlife a permit to land a cumulative landing of up to 350 pounds of summer flounder per calendar week in Rhode Island during the Summer sub period beginning June 1, 2008, as set forth in RIMF Regulations 7.7.1-2 (regulations effective 4/28/08) for the above named vessel. Cumulative landings of summer flounder for each week period may not exceed 350 pounds from June 1, 2008 through October 31, 2008 or until 80% of the Summer quota has been caught, whichever first occurs.
Conditions:
1. Each fishing week runs from 12:00 AM Sunday through 11: 59 PM Thursday. In each fishing week, Friday and Saturday will be closed to the commercial possession, sale, or landing of summer flounder.
2. The operator of any vessel permitted for the aggregate landing program shall sell, trade, or barter only to dealers reporting electronically to the Division using the Standard Atlantic Fisheries Information System (SAFIS). The operator shall report the following information to the dealer(s) upon landing: 1) Vessel Name, 2) Vessel Federal Permit Number, 3) Operator’s RI Commercial License Number, 3) Weight of Summer Flounder landed, and 4) Date landed.
3. The above referenced information shall be reported via the Standard Atlantic Fisheries Information System (SAFIS) and by providing the State’s copy of the Vessel Trip Report logbook or the reporting form provided by the Division of Fish and Wildlife to a DEM Law Enforcement officer upon request, including the name(s) and address(es) of the dealer(s) where the summer flounder were landed.
4. The State’s copy of the Vessel Trip Report logbook or the reporting form provided by the Division of Fish and Wildlife must be on board the vessel in numerical order for the entire summer sub period and must date back to January 1st.
5. Non-compliance with the provisions of RIMF Regulations 7.7.1-2 (regulations effective 4/28/08) or the enrollment agreement shall subject both the owner and the operator to revocation of enrollment and participation in the commercial fisheries for the subsequent Summer fishery. If for any reason a Summer fishery does not exist by regulation, the owner(s) and operator(s) privilege to commercially fish will be suspended for the same calendar time period as described in the current Summer period upon adjudication. Additionally, imposition of a penalty pursuant to Part 3.3 (RIGL 20-3-3) and the Rules and Regulations Governing the Suspension/Revocation of Commercial Marine Fisheries, Shellfish Buyer, Lobster Dealer, Finfish Dealer, and Multi-purpose Dealer, licenses issued pursuant to Title 20 of RIGL “Fish and Wildlife”.
6. The program will terminate on October 31, 2008 or when 80% of the Summer quota has been harvested as determined by Rhode Island Division of Fish and Wildlife and/or the National Marine Fisheries Service (NMFS), whichever first occurs. The possession limit per vessel will be 100 pounds per calendar day for summer flounder upon termination of the program. The Division of Fish and Wildlife will provide notice of the termination of the program.
By signing below the individual(s) agree(s) to follow the aggregate landing program agreement and the program regulations as set forth in RIMF Regulations 7.7.1-2 (regulations effective 4/28/08). The owner and any individuals who will be operating the permitted vessel must sign below. All other RIMF Rules and Regulations governing summer flounder are still in effect.
