Gene Kelly* an experienced environmental litigator who has had a distinguished career with New York State and the United States Marine Corps* has been named Director of the Department of Environmental Conservation’s (DEC) Region 4 office Commissioner Pete Grannis announced today.

“We are thrilled to have Gene back with us at DEC* and to have his impressive knowledge and understanding of the complex environmental issues facing both the region and our state*” Commissioner Grannis said. “Gene’s distinguished career has been focused on protecting our natural resources and serving our country* and we are fortunate to have him leading our Region 4 office.”

Most recently* Mr. Kelly served as an Assistant Attorney General at the New York State Department of Law. For 10 years* he represented the state in high profile* multi-party litigation brought against utilities under the Clean Air Act* including serving as lead attorney in the case against Cinergy Corporation. This groundbreaking air quality protection case brought against a Midwest utility by then-Attorney General Eliot Spitzer is due to go to trial next year. Mr. Kelly was also lead attorney on a case against the owners of the Della Villa Landfill in Rotterdam* which resulted in the closure of the illegal construction and demolition debris landfill.

Prior to working in the Attorney General’s office* he served for over four years at the DEC as an Assistant Regional Attorney in the Region 4 office* and as Senior Attorney in Albany Central Office where Mr. Kelly represented staff in a broad range of enforcement and permit proceedings and served as primary enforcement counsel for DEC in all Clean Air Act requirements* including coordination of regional enforcement priorities.

Mr. Kelly is currently a Lieutenant Colonel in the U.S. Marine Corps Reserve. He serves as an Environmental Law Judge Advocate* advising about Marine Corps-wide compliance with environmental and land use issues. As part of his past service in the Marine Corps* he also served as Adjutant/Site Judge Advocate for the 2nd Battalion 25th Marines in Long Island* Criminal Defense Counsel and Civil Law Officer at the Marine Corps headquarters in Quantico* Virginia.

Mr. Kelly received his Bachelor’s degree at Siena College* followed by receipt of his Juris Doctor from the Franklin Pierce Law Center in 1988. He also attended George Washington University’s National Law Center where he received credits towards a Master of Laws in environmental law.

DEC’s Region 4 includes nine counties in the Capital District/Northern Catskill area: Albany* Columbia* Delaware* Greene* Montgomery* Otsego* Rensselaer* Schenectady* and Schoharie. It covers almost 4 million acres* bordering Massachusetts and Vermont on the east and Pennsylvania on the southwest. Region 4 boasts a number of unique resources* including the Albany Pine Bush Preserve* four DEC campgrounds* the northern section of the Catskill Forest Preserve* the Five Rivers Environmental Education Center and part of the New York City Watershed.

In addition* Region 4 contains sections of four major river basins: the Hudson River Basin* characterized by the picturesque Hudson River Valley and including more than 60 miles of the Hudson River; the Mohawk River Basin* which includes more than 60 miles of the pastoral Mohawk River Valley; the Delaware River Basin* consisting of more than 100 miles of both the East and West Branches of the Delaware River; and the Susquehanna River Basin* with its namesake river beginning at historic Otsego Lake and meandering 40 miles through the region and ultimately emptying into Chesapeake Bay.
